TaxFight is operated by Aveyon Holdings Ltd.. This agreement is between you, the owner of the property named at checkout, and Aveyon Holdings Ltd..
1. What we do We act as your agent in a complaint about the assessed value of your property. That means we review your assessment against comparable properties, raise any errors we find with the City assessor during the customer review period, file a complaint with the Calgary Assessment Review Board before the deadline on your notice, and run a written or virtual hearing if the complaint is heard.
We fight your property assessment. We do not set your tax rate and we do not deal with your tax bill or your tax payments.
2. What we do not do We are not a law firm and nothing we provide is legal advice. Agents representing property owners before Alberta assessment review boards are not licensed or regulated, and we hold no professional designation in property assessment or appraisal unless we tell you otherwise in writing.
We do not attend in-person hearings on residential files. Residential complaints are run in writing or by video, which is how the board hears most of them.
3. Your authorization Before we can file anything, you must sign the official Assessment Complaints Agent Authorization (form LGS1405). It is prescribed by Schedule 4, Matters Relating to Assessment Complaints Regulation and we cannot act without it. We prepare it for you, pre-filled, and you sign it. It does not authorize us to make information requests under sections 299 or 300 of the Municipal Government Act. Those need separate authorization from you.
4. The board's filing fee The board charges 50 dollars to file a residential complaint, reduced to 40 dollars if the board receives it before January 31. You pay this fee directly to the board. We never hold it and we never pay it for you.
If the board decides in your favour, or if the assessor corrects every issue under complaint and the complaint is withdrawn before the hearing, the filing fee is refunded to you.
5. What the board can do The board can lower your assessment, leave it unchanged, or raise it. You should know that before you instruct us. We will not file a complaint we expect to result in an increase, but the decision is the board's and not ours.
The board cannot hear an argument about an issue that is not written on the complaint form, and an issue cannot be added after filing. We will put every issue we have found on the form. If you know something about the property that we do not, tell us before we file.
6. Fees Your tier and its price are shown at checkout and repeated in your confirmation email.
Any contingency fee is calculated on the first year reduction in property tax resulting from a reduction in your assessed value, and on nothing else. It is calculated as the reduction in assessed value multiplied by the combined residential tax rate published by the City of Calgary for the relevant year. We will show you that calculation.
Any amount described as non-refundable is not refunded if the complaint does not succeed.
All prices are before GST. GST at 5 percent is added at checkout.
7. If we get nothing, next year is on us. If we do not get your assessment reduced, your next appeal in January is free. This is not a refund of what you paid this year. It applies to the Split it and Keep it all tiers. It does not apply where you cancel, where you do not return your signed authorization in time for us to file, or where the board declines to hear the complaint because of information you did not give us.
8. Renewal Your engagement renews each January for the new assessment year, so that we re-screen your property and file again if it is worth filing. We email you in December before it renews. You can cancel in one click from that email or at any time from the link in any email we send you. If you cancel, we do nothing further and you are charged nothing further.
9. Your information We collect what we need to run your file and nothing else. Our privacy policy explains what we hold, why, and how to get a copy or have it deleted.
10. Ending this agreement You can end it at any time. If you end it after we have filed a complaint, we will withdraw the complaint unless you tell us to transfer it to you. Anything you have already been charged that is described as non-refundable stays non-refundable.
11. Law This agreement is governed by the law of Alberta.
